Brain & Head Injury Claims

Compensation from head injury claims often depends upon the severity of brain damage that has been experienced, operating on a scale of “minor” to “very severe”. Such claims generally need to be placed with 3 years of an accident taking place, although there are exceptions to this rule. In cases of criminal assault, two years is a more common time scale. In cases where the victim loses the ability to manage their own affairs or make important decisions, no time limit may be present.

Head and brain injuries are often the most worrying kind of accident. Lives can be turned upside down, not just for the individual, but their family too, so compensation is simply a representation of the pain and loss that you’ve suffered, as well as a helping hand in the aftermath when additional costs for care or changes to your living environment might be present.

The sad truth is that the vast majority of head and brain injuries in the workplace are often avoidable if an employer takes the proper precautions and complies with their legal responsibilities. This could be as basic as issuing the correct protective headgear; even the simplest precautions can prevent serious injury.

Here at The Claims Partnership, we understand how much a brain injury can have a dramatic impact on your life. Our expert head injury solicitors appreciate the difficult time that you are going through, and will handle your case delicately and with respect from our first meeting through to its conclusion. We will always give you the support and guidance you deserve. Your claim will also be no win, no fee based, eliminating any possibility of risk.

Common causes of head and brain injuries

Head and brain injury facts

  • Concussion is the most common type of brain injury
  • The second most common injury is a closed head injury, where the skull is not fractured
  • Penetrating brain injuries are the most serious, as an object has fractured the skull and entered the brain tissue
  • Diffuse brain injuries happen when the head is shaken and the brain movies within the skull. This can result in damage to different areas of the brain
  • The most serious brain injuries are brain contusions. This is where the skulls cracks or breaks and a fragment presses or penetrates the brain tissue

Case Study

A Train Station Employee Trips at the Entrance to the Train Station

Catherine worked as a Counter Assistant at a train station. She was walking into the station on her way to start work one morning. At the very entrance to the station was a small area covered with traditional paving stones. The paving stones were a little uneven. One of the paving stones was approximately 15 mm higher than the other one. As she stepped off it, she lost her balance, falling forwards and sideways and landing on her left arm. She suffered a serious fracture to her left arm and her left elbow.
