Scar and Laceration Injury Claims

A scar occurs when the body heals itself following an injury. Some scars are temporary and will fade over time. Others, perhaps from more serious injuries, can be permanent.

Scars and laceration injuries are relatively common workplace injuries, particularly in the Catering and Cleaning industry. Any working environment which involves extreme temperatures, chemicals, electrical equipment or sharp machinery presents a risk of a burn, scar or laceration.

Whether temporary or permanent, scars can affect people in a number of different ways. Not only are they painful initially, they can leave behind deep psychological and emotional trauma long after the physical pain has gone. Loss of confidence is common, particularly if the scar is visible such as on the face or neck.

Common causes of scar injuries

  • An employee’s skin comes into contact with a chemical that causes a burn or scar
  • An employee’s body comes into contact with an unprotected blade that causes a laceration
  • An employee slips and comes into contact with or causes a spillage of chemicals or boiling water

How much compensation will I receive?

There is no set amount of compensation awarded to scar injury claims or laceration claims. There are a number of factors involved that will determine how much you will receive, including the extent of the scar injury and whether it will be temporary or permanent. If the scar could be removed or its appearance improved through cosmetic surgery, then the cost of the procedure may be included in the settlement amount.

Part of your scar injury claim will involve seeking a medical report from a cosmetic surgeon who will be able to provide an expert opinion on the extent of the injury, if the scar can be removed and a prognosis for future symptoms.

Case Study

An HGV Driver Slips on an Icy Works Car Park

Gareth worked as an HGV Driver for a large national delivery firm. His job required him to be on the road early in the morning when motorway congestion is at its lowest. He needed to clock in each morning at 3:30 am, before getting on the road for 4 am. His employer operated a large Heavy Goods yard where Gareth would collect his vehicle for the day. Drivers were required to park their own vehicles on a staff car park situated outside of the main Heavy Goods Yard. Gareth arrived at 3:20 AM and parked his car. The weather conditions had been freezing during the night. There had also been a light rainfall which meant that the staff car park was icy in places. As he began to walk across a car park to the entrance gate of the Heavy Goods Yard, he slipped backwards on the frozen ground, banging the back of his head on the car park floor.
