Most of the time an employer has not met their legal obligations to make sure you are safe in your job. These obligations include:

– Regularly inspecting floors, yards, pavements and car parks within the workplace that that will be vulnerable to ice and snow.

– Being alert to the possibility of ice or snow in advance and ensuring that steps are taken to make sure car parks, pavements and floors are gritted and made safe before workers arrive.

– Ensuring that grit is available and that there are designated staff on duty to grit floors before ice or snow is expected and when ice and snow are on the ground.

– Making sure that there are no potholes in car parks, roads and pavements within the workplace that might collect water and might freeze

– Ensuring that frozen and dangerous areas are fenced off.

– Making sure that rainwater or other sources of drips or leaks that might freeze do not come to be on the floor.

An HGV Driver Slips on an Icy Works Car Park

Gareth worked as an HGV Driver for a large national delivery firm. His job required him to be on the road early in the morning when motorway congestion is at its lowest. He needed to clock in each morning at 3:30 am, before getting on the road for 4 am. His employer operated a large Heavy Goods yard where Gareth would collect his vehicle for the day. Drivers were required to park their own vehicles on a staff car park situated outside of the main Heavy Goods Yard. Gareth arrived at 3:20 AM and parked his car. The weather conditions had been freezing during the night. There had also been a light rainfall which meant that the staff car park was icy in places. As he began to walk across a car park to the entrance gate of the Heavy Goods Yard, he slipped backwards on the frozen ground, banging the back of his head on the car park floor.
