Will and Inheritance Disputes

Losing someone close to us is one of the saddest events any of us will ever face in life. Unfortunately, more often than not, it is a situation that can be made worse where that person has not made provision for you or someone close to you in their will.

This can happen for a number of reasons. For example, the will may have been drafted many years ago and is out of date, or it may be out of touch with the intentions of your loved one. Another example that we regularly deal with is that someone may have influenced your loved to change the direction of the will, or simply that a family member has unfairly been left out of the will. The will could have been carelessly drafted by a solicitor, or may be invalid as a legal document.

Who can make a will and inheritance dispute claim?

  • A spouse or civil partner of the deceased
  • A person being cared for by the deceased prior to their death
  • A divorced spouse, separated spouse or separated civil partner of the deceased. They must not have remarried or entered into another civil relationship
  • Any children of the deceased, including adults
  • Any person who was treated by the deceased as their child. As well as natural children, this also includes children and adults who were fostered, adopted or became stepchildren, or anyone else that the deceased looked upon as being their child
  • Any person living with the deceased for a minimum of two years prior to them dying

Can you advise me on a current inheritance situation?

A Classroom Assistant Breaks Her Elbow After Slipping On a Wet Classroom Floor

Jenny* worked as a Classroom Assistant in a Primary School. Her job involved her in getting to school early each morning to prepare the classroom for the children's lessons that day. The floor of the classroom where she worked was half carpet and half floorboards. Shortly after she had entered the classroom, she stepped off the carpeted area to walk towards the sink. She did not know that the cleaner had been in the classroom and mopped the floorboards approximately 15 minutes before she had entered the classroom. The cleaner had not properly dried the floor after she had mopped it and had not left a Wet Floor sign on the floor, even though she knew that Joyce would be arriving shortly after she finished.
