Criminal Injury Compensation Claims

If you have been the victim of an unprovoked physical assault, or have been subject to mental or sexual abuse, then you may be entitled to claim Criminal Injuries compensation.

If you were injured in a motor vehicle accident involved a criminal offence, such as drink driving, that you may also be entitled to claim from the Criminal Injuries Compensation Authority.

Not everybody will qualify for an award of compensation. That scheme is tightly enforced and anything the authority deems to be a trivial injury will not qualify for an award.

Are you eligible to claim compensation?

In order to qualify for a criminal injury claim you must satisfy the following conditions:

  • You must have reported the attack promptly to the police and provided them with all the assistance they have asked for.
  • The assault must have happened in the last two years.
  • You must be free of any criminal convictions yourself, although in certain circumstances where an criminal injury victim has a minor criminal record for a non-violent offence, then it might still be possible to claim compensation, but at a reduced rate.

Is it possible to make a claim myself without using a Solicitor?

Yes it is possible to claim from the Criminal Injuries Compensation Authority directly. You can register and log your claim on line at https://www.gov.uk/claim-compensation-criminal-injury

How much compensation will I be entitled to?

This depends upon your injuries. Awards of compensation start at £1000. Injuries such as a broken nose or cracked ribs will qualify for an award of between £1000 and £1500.

For serious injuries and abuse, payments of up to £500,000 can be made. Awards can include compensation for lost wages, where there is an extensive loss of earnings claim.

Loss of both eyes – £110,000

Dislocated jaw – £3500

Fractured cheekbone bone – £2400

A fracture to the skull requiring and operation – £3500

A dislocated or broken elbow with significant disability – £6200

A fracture of the index finger – £1800

A dislocated shoulder with with ongoing disability – £3500

A fractured wrist – £2400
